  • The site and all its services are free and need no account.
  • Do not send unlawful content or try to get around the site's safeguards.

This document is the terms of service required by Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means. It is available free of charge at this address before you use any service, and you can save or print it from your browser.

These terms cover the site, the candy jar app for Android and their services. Commissions from the Services page go through VulCode (code) and Aphrodi (brand and design) on their own terms, so these terms do not cover them.

What services I provide

All services are free:

  • Browsing the site: information about me, my services, projects, open source work and interests, including the library and the music section on the Beyond code page.
  • Blog: posts to read on the site and an RSS feed at dualfroz.com/blog/rss.xml.
  • Contact form: sending me a message from the Contact page.
  • Referral links: counting visits and page views from links with a referral code.
  • Candy jar: drawing a candy with a message and an on-page effect, plus public draw statistics. Some candies open another site in a new tab.
  • Candy jar app for Android: jar statistics, notifications about draws and announcements, and home screen widgets.

Candies from the jar are just for fun: they have no value and cannot be exchanged for anything.

Starting and ending the agreement

An agreement to provide a service is formed when you start using it: you open the site, send the form, draw a candy or install the app. It lasts for as long as you use the service.

You can end it at any time without giving a reason: close the site or uninstall the app.

I may change or switch off a particular service, for example the jar. This does not affect matters already under way, such as complaints.

Technical requirements

  • A device with internet access and an up-to-date browser such as Chrome, Firefox, Safari or Edge, with JavaScript enabled.
  • Without JavaScript some pages show their text only, but the form, the jar and the language switch will not work.
  • The form and the jar need access to challenges.cloudflare.com (Turnstile verification). If that address is blocked, the check will not appear and you will not be able to send a message or draw.
  • The site uses the lang cookie to remember your language.
  • The candy jar app runs on Android 8.0 or newer.

Using the internet carries the usual risks, such as malware or sites impersonating well-known services. This site works only over encrypted HTTPS and never asks for passwords or payment details, so do not enter them in the form.

Rules of use

When using the site and the app, you must not:

  • send unlawful content, including content that infringes other people's personal rights or copyright
  • send spam or impersonate other people
  • get around the verification and limits, or send automated requests in bulk to the form, the jar or the site's API
  • inflate referral link visits artificially
  • attack the site or disrupt how it works

I may delete messages that break these rules without replying, and block requests from addresses that abuse the site.

Liability

The content of the site is for information only and is not an offer within the meaning of the Polish Civil Code. Blog posts are my opinions and notes from my work.

I take care to keep the site running, but there may be interruptions, for example during maintenance, failures or outages of external services such as Cloudflare or Spotify.

The owners of sites that links lead to are responsible for their content.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, or any rights consumers have under the law.

Complaints

If a service does not work as these terms describe, write to me@dualfroz.com.

In your complaint, describe the problem and when it happened. If the reply should go to a different address than the one you write from, include it.

I will reply by email within 14 days of receiving the complaint.

Personal data

What data the site and the app collect, why and for how long is described in the privacy policy.

Governing law and disputes

These terms are governed by Polish law. If you are a consumer, you keep the protection given to you by the mandatory rules of the country where you live.

Disputes are settled by the court with jurisdiction under general rules. Consumers can also get free help from a municipal or district consumer ombudsman (rzecznik konsumentów) in Poland.

Changes to these terms

I may change these terms for good reasons: changes in the law, a new or discontinued service, or security. The new version is published at this address with a new effective date.

A change does not affect matters started earlier, such as complaints in progress. If you do not accept the new version, you can stop using the site.
